Ashley also noted in the filing that the 2017 Daytona 500 winner asked her to leave the house by the first week of June.
She also wrote in the document that the couple did sign a prenuptial agreement.
Kurt was previously married to Eva Bryan in July 2006 and divorced in June 2011 nearly five years later.
